The Judiciary has ruled in favor of the Public Ministry of Ceará's Civil Action and, on Thursday (September 17th), ordered the Farias Brito City Hall to allow people to bring food and drinks for personal consumption into the free area of ExpoVaq 2026, under penalty of a fine of R$ 10,000 per day of non-compliance. The event continues until next Sunday (September 20th) at the Expo Park and Municipal Stadium "O Zezão".
The Public Prosecutor's Office of Farias Brito had already issued a recommendation instructing the management and organizers to allow the entry of drinks and food, in accordance with Municipal Law No. 1.669/2026. However, this recommendation was not followed.
In the action, the Public Ministry highlights that, despite the sale of drinks within the festival space being carried out exclusively by the company that won the tender that regulated the commercial exploitation of ExpoVaq, this does not prevent the public from accessing the free areas with food and drinks purchased outside the venue.
According to the Public Ministry, this practice does not constitute a breach of the "exclusivity" of the contract, even if it was concluded before the municipal law came into effect this year. "Even if the legal provision were contrary to the clause in the contract, the law must prevail, as it is hierarchically superior to administrative contracts," argued the Public Ministry in the action ruled upon by the Judiciary.
