Bill 2005/26 prohibits the manufacture, import, sale, transport, storage, and advertising of electronic smoking devices (ESDs), such as e-cigarettes, vapes, and heated tobacco products.
The text under analysis in the Chamber of Deputies also expressly prohibits the use of these devices in enclosed public or private venues.
For the author of the proposal, Deputy Fábio Teruel (MDB-SP), these devices do not represent a safe option for users. "ESDs pose risks of acute toxicity, which can quickly develop into serious conditions," he said.

The proposal amends theLaw 9.294/96, which addresses restrictions on the use and advertising of tobacco products, and theThe Statute for Children and Adolescents (ECA)to prohibit the sale, delivery, and advertising of these products to people under 18 years of age.
The regulation will be the responsibility of the National Health Surveillance Agency (Anvisa). The text also provides for cases that aggravate penalties and holds digital platforms, social networks, and other applications responsible for removing illicit content.
Next steps
The proposal will be reviewed by the committees of Industry, Commerce and Services; Health; Social Security, Social Assistance, Childhood, Adolescence and Family; and Constitution and Justice and Citizenship. It will then proceed to the plenary session.
To become law, the text must be approved by both the Chamber of Deputies and the Senate.
