
Provisional Measure 1393/26 establishes the third phase of the program for renegotiating personal debts, called Desenrola Brasil 3.0.
The main novelty of this program phase is the authorization for the Union to hold auctions to purchase non-paid debt portfolios, fully passing on the obtained discount to the debtors.
The first two phases together reached approximately 25 million people. The first phase included over 8 million renegotiation operations, with R$ 53 billion in debts renegotiated and 15 million people and families assisted. The second phase recorded over 5.5 million operations, R$ 22 billion in debts renegotiated, and 10 million people and families assisted.
Credit cards and personal credit
Desenrola 3.0 will focus on credit card debts, in the installment and revolving modes, and personal credit without payroll assignment.
According to the text, debt portfolios from both banks and non-banks with an original value of up to R$ 10,000 can be integrated into the program. The time of default must be between 720 and 1,645 days (approximately two to four and a half years).
The government estimates that up to R$ 150 billion in debts may be renegotiated under the program's rules. If a debt does not meet these standards, it is excluded and cannot receive the benefits (such as discounts in government auctions).
The proposal is for the Union to purchase the credit portfolios of financial institutions at a 90% discount. This is estimated to cost R$ 15 billion to acquire R$ 150 billion in debts.
Creditors
The minimum discount provided in the auctions is 90% of the debt value, a percentage that will be fully transferred to the debtor. The remaining balance can be settled in a lump sum or in installments (with interest), according to rules to be established by the National Monetary Council (CMN).
Creditors will participate in auctions divided into lots (bank or non-bank), with proposals ranked by the highest discount offered.
It is mandatory for the creditor to submit the entirety of the eligible credits of each debtor, without partial exclusion. The operation may involve the Federal Savings Bank and the Brazilian Bank, as well as investment funds in credit rights with Union participation.
Implementation schedule
- November 2026: publication of the call for proposals submission.
- December 2026: submission of proposals by creditors.
- January 2027: approval of selected proposals.
- February 2027: signing of contracts and start of the transfer of the discount to debtors (cash settlement or installment).
Next steps.
As with any provisional measure, the norm is already in force since publication, but it needs to be approved by the Chamber and the Senate within 120 days to become a law.
