The Chamber of Deputies approved the annual adjustment of the costs and emoluments of the Labor Courts by the Broad National Consumer Price Index (IPCA). The bill goes to the Senate for voting.
The proposal also establishes the Special Fund for Labor Justice to finance the modernization, improvement of judicial services, and maintenance of Labor Justice activities. The fund will be subordinated to the Superior Labor Court (TST).
The text approved in Plenary on Tuesday (1st) is aamendmentby the rapporteur, Deputy Soraya Santos (PL-RJ), to Bill 1290/22, by the Labor Court (TST). In the original text, the annual adjustment would be byINPC, also administered by the Brazilian Institute of Geography and Statistics (IBGE).
The rapporteur defended the approval of the measure. "This rate needs to be adjusted annually. An agency cannot be constantly dependent on the Congress. These are the expenses of a Justice so necessary in the Country," argued Soraya Santos.
Costs
The proposal already includes an adjustment for current expenses:
- process knowledge: increase from R$ 10.64 to R$ 12.02;
- acts of attachment, of adjudication and of remission: maximum value of R$ 2,163.83, instead of R$ 1,915.38;
- acts of court officers, by certified notice: from R$ 12.49 to R$ 25.00 (currently from R$ 11.06 to R$ 22.13);
- motion for injunctive relief or motion to dismiss: R$ 50.00 (today is R$ 44.26);
- appeal or objection to the judgment of liquidation: R$ 63.80 (today is R$ 55.35);
- settlement calculations performed by the court accountant regarding the settled amount: limit of R$ 721.28 (currently R$ 638.46).
The fees will cost from R$ 0.32 to R$ 6.25 per sheet. Currently, the values range from R$ 0.28 to R$ 5.53.
