The Public Prosecutor's Office of Ceará, through the 2nd Prosecutor's Office in Eusébio, has filed a criminal complaint against a businessman for committing environmental crimes in the municipality. According to the MP, the accused allegedly built the company's fence on a permanent protection area along the Coaçu River, causing damage and changes to the course of the waterway, as well as pollution and a decrease in water volume.
IncomplaintThe Public Prosecutor's Office points out that the location where the company's headquarters was built is prone to flooding, and after a large volume of rain in 2021, the building's facilities and the safety of workers were affected. For this reason, the businessman requested support from the Eusébio City Hall to break through the Jaboti road to allow for the drainage of water. The interventions were authorized by the Municipal Environmental Agency (AMMA), provided that they respected the setbacks of the Permanent Protection Areas (APP) and complied with the legislation of the Forest Code. However, a retaining wall was built along the riverbank, through earthmoving without any authorization from the Ceará State Environment Secretariat (SEMACE), and the authorization was obtained only later.
The prosecution highlights that this construction damaged the native tree ecosystem and generated a buildup of debris, garbage, and organic matter at the bottom of the water body. Other consequences pointed out in the complaint include the discharge of sewage into the river, putting the health of the population at risk; the loss of biodiversity; and the risk of eutrophication in the water, i.e., an increase in the amount of nutrients that cause the death of species and the proliferation of algae.
In the complaint, the Public Prosecutor's Office requests the businessman's conviction for causing damage to the protected area, destroying Atlantic rainforest vegetation, and generating pollution, all environmental crimes covered by Law 9.605/1998.
